Bill Moshofsky Authors New Book,

“Regulatory Overkill.”

On Oregon's Land Use Regulations

Moshofsky’s new book explains why Measure 37 is needed and why further land use regulatory reforms are necessary.

The book addresses not only the “land use planning” (regulatory) system, it also covers unfair and excessive wetlands, endangered species and forest practice regulations.

It discusses in detail how the regulatory system needlessly crams almost all people and development on less than 2% of the land in the state, unfairly strips landowners of their rights to use their land, blocks development and escalates its cost, makes housing unaffordable, hurts the economy, intentionally increases traffic congestion to get people out of their cars, impairs quality of life, and reduces tax revenues needed for schools and public services.

The book provides historical background – how the regulatory system evolved and where it went wrong. It also exposes the utter failure of the courts and the legislature to provide protection for property rights, one of our most basic civil rights.

Bill Moshofsky is uniquely qualified to write this book. He was involved in the 1973 legislative process when Senate Bill 100 (the “land use planning” law) was enacted, and in its subsequent implementation., including serving as a member of a legislative interim committee dealing with some problems with the law. For the past 15 years, he has worked on land use regulatory matters as a nearly full time volunteer with the Oregonians In Action organizations in the legislative arena, in the courts, with local governments, in the media and on ballot measures. He is President of OIA Legal Center, President of OIA Education Center and Vice President, Government Affairs, for Oregonians In Action.

Bill also dealt with land use concerns in Oregon and across the country as a lawyer in Portland and Klamath Falls for 10 years and as an attorney and executive for 23 years with Georgia-Pacific, which had extensive land holdings. He had responsibility for the corporation’s government affairs, environmental matters and transportation.
